Mineral Mocktail Mini Course Terms & Conditions
The education provided in the Mineral Mocktail Mini course is for the purpose of promoting health and is not considered treatment for any specific illness. Members are not receiving Medical Nutrition Therapy (MNT) from Robyn Johnson on behalf of Nutrition by Robyn, LLC. For the treatment of a specific illness, we recommend consulting with your physician or a functional medicine dietitian.
If you engage in this program and implement any changes you do so with the understanding that Robyn Johnson on behalf of Nutrition by Robyn, LLC do not dispense medical advice nor prescribe treatment. Rather, this course provides education to enhance your knowledge of health as it relates to foods, dietary supplements. While nutritional and botanical support can be an important complement to my medical care, you understand it is not a substitute for the diagnosis, treatment, or care of disease by a medical provider. 
If you engage in this program and implement any changes, you agree that you do so at your own risk, are voluntarily participating, assume all risk of injury to yourself, and agree to RELEASE AND DISCHARGE Nutrition by Robyn, LLC, its employees, and Robyn Johnson from any and all claims or causes of action of any kind, known or unknown, arising out of your use or implementation of Nutrition by Robyn, LLC’s program, information, and/or its website. You understand that Robyn Johnson on behalf of Nutrition by Robyn, LLC is not a physician, and that you should see a doctor if you think you have a medical condition. Nutrition by Robyn, LLC will not be held liable for failure to diagnose or treat any disease.

Request for Permission to Use Content
Any request for written permission to use our Content, or any other intellectual property or property belonging to us, should be made before you wish to use the Content by sending an email to info(at)nutritionbyrobyn.com.

No Sharing
You cannot distribute, copy, forward and/or share the Program or its content with anyone else. Any violations of these Terms of Use will be legally pursued to the fullest extent permitted by law.
You may not share your password or login information with anyone. If you share your password or login with anyone who did not purchase the Program, you will be removed from the Program immediately and no refund will be issued. 

No Claims Made Regarding Results:
Any and all current or past-client testimonials, statements, or examples used by us are simply that: examples. They are not guarantees that you will also experience or receive the same results. Each person and his/her circumstances are unique and nothing shall be interpreted as a guarantee that you will experience the same results as another client of ours. 
Purchase Agreement
Member understands, acknowledges, and agrees he/she is purchasing the self paced, Mineral Mocktail Mini course program. Company will provide full access to the Mineral Mocktail Mini course program for the lifetime of the program. When you pay for the Program by credit card, you authorize and give permission to Nutrition by Robyn, LLC to charge your credit or debit card for the amount owed for payment of the Program. When you purchase the Program, your information (i.e. credit card and contact info) may be collected by the third-party merchant Stripe (depending on the payment method you choose at checkout), who may have privacy policies or security practices that are different than ours.  Nutrition by Robyn, LLC is not responsible for the merchant’s independent policies or practices.

Refund Policy  
a. Company is not able to offer refunds once Member has purchased the Program. Member understands this provision, and agrees that he or she is not entitled to a refund once payment has been issued to Company. 
b. Member further agrees and understands that changing his/her mind about the Program, failing to follow through or understand the details of the Program, not experiencing the results he/she expected or desired, or experiencing any other similar situations does not entitle her to a refund.

Your Release of Us, Indemnification, Hold Harmless:
To the fullest extent permitted by law, Nutrition by Robyn, LLC expressly disclaims liability for any direct, indirect, and/or consequential damages suffered by you related to your purchase or use of, or participation in, the Mineral Mocktail Mini course and HTMA testing/review, its materials, our website, or any other information obtained by you from us. By enrolling in the Mineral Mocktail Mini course and HTMA testing/review, you hereby agree to this limitation of liability and release Nutrition by Robyn, LLC from any and all claims.
 
By participating in and/or purchasing the Program, you agree to release, forgive, forever discharge, defend, indemnify, and hold harmless Nutrition by Robyn, LLC, our subsidiaries, employees, agents, contractors, subcontractors, shareholders, directors, officers, coaches, assignees, licensees, and affiliates from any and all claims, suits, actions, charges, demands, liabilities, damages, judgments, and/or costs, related to, or arising out of, your purchase of or participation in the Mineral Mocktail Mini course and HTMA testing/practitioner review and/or your breach of any obligation, warranty, covenant, or representation set forth in these Terms of Use. 
 
By enrolling in the Mineral Mocktail Mini Course and completing HTMA testing, you agree to release us from any and all claims, and further agree to at all times defend, indemnify, and hold harmless Nutrition by Robyn, LLC and all employees as stated in this section herein. 
 
ARBITRATION CLAUSE:
If you have any complaint or should any issue arise in the use of the Program, please contact us directly first by emailing Robyn Johnson at [email protected]
 
However, if we are unable to amicably resolve your dispute in that manner, you agree that you and Robyn Johnson & Nutrition by Robyn.com shall submit your dispute to binding arbitration with the American Arbitration Association, before an arbitrator that is mutually agreed upon, in accordance with the American Arbitration Association’s (“AAA”) rules.
 By agreeing to this term, you hereby agree and understand that you’re waiving your right to a jury trial in court, which would otherwise be available to you if not for this Arbitration Clause. Should any arbitration hearing need to be held, it shall be held within 50 miles of Cedar Park, Texas.
If the arbitrator issues an award and a judgment is made, the judgment will be binding and will be entered in court in the State of Texas. The only award that can be issued to you is a refund of any payment made to Nutrition by Robyn for the applicable Program. You are not permitted to seek additional damages, including consequential or punitive damages.
 
HTMA testing & Practitioner Review  
I understand HTMA (Hair Tissue Mineral Analysis) test I am completing are used for educational purposes only and is not used as a diagnostic tool.1.  The purpose of nutritional counseling is to improve the overall health, vitality and well-being of the body through nutritional education and the use of natural foods and non-medicinal nutritional supplements. The Registered Dietitian Nutritionist, Robyn Johnson and all employees, does not diagnose diseases, disorders or conditions.
 
Refund policy & test deadline
 Refunds will not be issued for the Program nor Hair Mineral Testing once it is purchased. If you have any questions or concerns, or if there is anything we can do to make your experience a more pleasant one, please email [email protected]
If you order a Hair Mineral Test, you must use and complete your test within 12 months of your purchase. Refunds will not be issued to those who do not complete their test within 12 months of purchase. If you do not complete your test within 12 months of purchase & still wish to complete testing with an analysis, you must re-purchase a new test.
